Judges Restoration Order Can Not be Withdrawn

ISLAMABAD, News Trends: Supreme Court of Pakistan Friday in a brief judgment said that the notification of judges’ appointment could not be taken back.
A 17-member bench of the apex court headed by Chief Justice of Pakistan Iftikhar Mohammed Chaudhry started suo moto hearing after media reports said that the government considering to withdraw the notification through which the judges of the superior courts were restored.
The court called the signed statement of Prime Minister Yusuf Raza Gilani to know the federation’s stance on the matter.
But the Attorney General failed to produce the statement of the prime minister on the issue.
The apex court in its brief verdict said the withdrawal of the judges restoration notification will be violation of the constitution that will be liable to action under Article 6 of the constitution.
CJ hails Parliament for not approving of Nov 3 acts
Chief Justice Iftikhar Muhammad Chaudhry on Wednesday hailed the Parliament for being upright and having all the characteristics like legislative assemblies of any other country.
A 17-member bench under the head of Chief Justice Iftikhar Chuadhry was hearing identical petitions against some clauses of 18th amendment.
We respect the Parliament, which comprised sane people for they have not approved of the November 3rd acts, the CJ observed.
Attorney General Maulvi Anwarul Haq read the letter by Raza Rabbani in the court, which stated that since the court has not summoned him, he decided, after consultation with friends, not to appear before the court. Upon this, the CJ remarked that he was made a party in the case, but if he is not willing he may not come to court.
Advocate Akram Sheikh argued that, What is the need of judicial review when the court cannot scrap any of the amendment? He said the constitutional committee did not feel the need to consult the Chief Justice on Article 175-A.
CJ annoyed Over Non-Suspension Of NAB Chairman
Chief Justice Iftikhar Muhammad Chaudhry has expressed annoyance over non-suspension of the NAB chairman, and termed it a sheer disrespect on part of the government of the verdict of 17-member bench of the Supreme Court.
During the hearing of Harris Steel Mill case, the CJ remarked that under which law, bargaining has been made with the accused of the Harris Steel Mill scam. The counsel of Bank of Punjab told the court that so far around Rs8billion has been recovered in the fraud case, adding that NAB is cutting Rs200million as commission. The CJ said that NAB is not Blackwater, and questioned that why did the NAB seek commission. The case was deferred till tomorrow.

Petition Filed for Review of SC Decision on NRO
LAHORE, Pakistan News: A petition seeking review of Supreme Court’s 17-member bench decision on NRO has been filed in Lahore Registry branch of the SC.
Filed by barrister Zafarullah, petition maintains that under the international laws President Zardari couldn’t be tried for Swiss Cases. It says that under article 248 of the constitution, president has immunity. The petitioner requested the court to review its decision.
