ISLAMABAD: The Supreme Court (SC) today continued hearing the case relating Eighteenth Amendment, Geo News reported Tuesday.

The apex court allowed Advisor to Prime Minister and Chairman Implementation Committee on 18th Amendment Senator Mian Raza Rabbani to appear before the court hearing the case.

A 17-member larger bench headed by Chief Justice of Pakistan Justice Iftikhar Muhammed Chaudhry is hearing a case relating fifteen identical constitutional petitions filed against some clauses of the amendment particularly challenging the judicial commission’s formation under the 18th amendment saying it is against the judiciary’s independence.

A petitioner Nadeem Ahmed’s counsel Akram Ssheikh submitted in his preliminary arguments, ‘The concerned people in the media or textile were approached for their opinion before morphing the policy in the respective sectors; but, judiciary was not consulted on issue of judges’ appointment. This is dishonesty.’

Justice Asif Saeed said in his remarks that the Parliamentary Committee had not said this anywhere that the present judicial system collapsed.

Justice Tassadduq Jilani queried the counsel, ‘Was judiciary in Britain was sought to give opinion before any change was effected in the modus operandi of the judges’ appointment? Or, was the Parliament made part to the process? ’

The CJ asked Akram Sheikh as to what purpose did Article-7 of the Constitution serve when it did not include judiciary in the definition of the state.

Also, Advocate on Record (AoR) Mehmood A Sheikh also filed an apology today on show-cause notice, the apex court issued to him yesterday in the same case.
