Halle Berry is asking the judge who is in charge of the custody hearing if she can have permission to move Nahla to France with her and her boyfriend. Gabriel Aubry is stating that over his dead body this is something that is just not going to happen.

Halle Berry has already put her papers to the judge and currently the only thing they are waiting on is the hearing date to be set. Gabriel Aubry feels that Halle Berry is doing this to take his daughter away from him by making sure that he can have no contact with her. Also, Gabriel Aubry is even more upset because if the move is approved Halle Berry’s long term boyfriend Olivier Martinez will also be residing with his daughter.

From the way we see it Halle Berry has a good reason to move. Matter of fact, the stalker who broke in her property numerous times has just been released from jail. So, she will definitely be safer over in Europe.

9be9halle gabriel1 Halle Berry and Gabriel Aubry: UpdateWhen we last reported about this situation it was revealed that Children and Family Services were getting involved and they have spoken. The L.A. County Children and Family Services feel as though Nahla needs to go to counseling. Currently, Halle Berry has not been accused of abusing her daughter but her baby daddy Gabriel Aubry is a whole different story. The nanny has said to have witnessed this herself as well as experienced some of the abuse from Aubry.

Halle Berry and Gabriel Aubry both have to appear in court today. Halle Berry is hoping that the judge prohibits Gabriel from being around their daughter until the investigation is over. However, Gabriel has plans as well. He is seeking to have a restraining order against the nanny and have her fired because he feels as though the only reason she is making up these stories is so she can get on Halle’s good side. However, Gabriel Aubry is the one who has enrolled in anger management classes to help control his temper.

We are not sure what exactly is going to take place in the courtroom today but we do know that it is quite likely that Halle Berry will be asked to testify.

Shahzad makes maiden appearance in Court

NEW YORK: Times Square bombing suspect Faisal Shahzad appeared in court for the first time Tuesday, more than two weeks after he was pulled off a flight headed to Dubai and taken into custody.

Shahzad, wearing gray prison garb and sporting a black beard, spoke only once during a hearing that lasted less than 10 minutes. The 30-year-old resident of Shelton, Conn., said “yes” to confirm that he lacked the financial means to pay for his own lawyer. He showed no emotion as the judge advised him of his rights. He was not handcuffed during the hearing.

Shahzad was taken into custody on May 3 at John F. Kennedy International Airport, two days after he allegedly tried to set off a car bomb in Times Square. He was allowed to board an Air Emirates flight despite being on a no-fly list, but was taken off the plane after it had pulled away from the terminal.

Since his arrest, he has been providing information to federal authorities. Last week, authorities executed search warrants in Massachusetts, New Jersey and on New York”s Long Island as they tracked Shahzad”s funding. Two men were taken into custody in Massachusetts and a third was arrested in Maine on suspicion of immigration violations.

On Tuesday, U.S. Magistrate Judge James C. Francis IV asked if Shahzad had waived his right to a speedy court appearance. U.S. prosecutor Randall Jackson responded that he had previously done so.

The courtroom, which was cleared for a brief security sweep prior to the hearing on late Tuesday afternoon, was packed. Mr. Shahzad was ringed by federal agents, didn”t look at the crowd gathered behind him in the small room and only nodded as his lawyer spoke on his behalf to the judge.

Shahzad faces five charges: use of weapons of mass destruction; acts of terrorism transcending national boundaries; use of a destructive device in connection with a crime of violence; transporting and receiving explosives; and damaging and destroying property by means of fire and explosives.

He could face life in prison on the two terrorism charges. A preliminary hearing was set for Shahzad on June 1.

The judge granted prosecutors” request to keep Shahzad in custody. Julia Gatto, his lawyer, asked that Mr. Shahzad receive Halal meals while in detention. The judge agreed. When the hearing ended, Mr. Shahzad was handcuffed and led out of the courtroom by U.S. marshals. It”s unclear where he will be held. Ms. Gatto declined to comment after the hearing.

A U.S. citizen originally from Pakistan, Shahzad has told authorities that he received bomb-making training in Pakistan. U.S. authorities have said he admitted to constructing a crude explosive device, which included fireworks and propane gas canisters, and left it in a Nissan Pathfinder in Times Square on the night of May 1. The device was discovered after a street vendor saw the unattended vehicle smoking in the vicinity of 45th Street and Seventh Avenue.

Injured Reds pitcher Edinson Volquez says his 50-game suspension for violating Major League Baseball’s policy on performance-enhancing drugs is the result of medications he took to treat a fertility condition

Volquez, 26, last pitched June 1 and went on the disabled list to undergo Tommy John elbow surgery in August. He has been rehabbing since and is not expected to return until after the All-Star break this season. The right-hander was 4-2 with a 4.35 ERA in nine starts last year. His breakout season was 2008 when he was 17-6 with a 3.21 ERA and was named to the NL All-Star team.

According to MLB, Volquez will begin serving his suspension tomorrow and will conclude June 13, before he is expected to begin rehabbing in the minor leagues. Volquez will be docked 50 games of pay which amounts to roughly $137,950 on his annual salary of $445,000.
There have been 25 suspensions by MLB for violating the sport’s drug policy since they first started in 2005. Dodgers outfielder Manny Ramirez was the last major leaguer to be suspended 50 games when he was banned May 7 for taking human chorionic gonadotropin (HCG), a women’s fertility drug that is popular among steroid users because it can lessen the side effects.
