Ijaz statement can be recorded via audio/video link: Justice Essa

ISLAMABAD:  Memo Commission head Justice Qazi Essa has proposed that statement of Mansoor Ijaz can be recorded through an audio or a video link under Article 164 of the law of testimony.

Ijaz counsel Advocate Akram Sheikh said his client is ready to submit an affidavit to appear before Pakistan High Commission to record his statement.

On this, Haqqani’s counsel Advocate Zahid Bokhari said Mansoor Ijaz is a fugitive in four cases in the United States. He said Mansoor Ijaz cannot enter the United States.

Justice Qazi Essa said a senior officer could be appointed in Pakistani High Commission in London to identify Mansoor Ijaz. He proposed that Ijaz statement could be recorded under Article 164 of the law of testimony.

Bokhari said he personally doesn’t agree with the proposal. But he said he would consult his client. TrendPK

SC throws out PM’s intra court appeal

Now PM Yousuf Raza Gilani will appear in the court on February 13 to face the contempt charges against him.

He will be indicted in the court a, said his lawyer Aitzaz Ahsan in his brief press talk after the verdict.

The Supreme Court earlier this month ordered Gilani to appear on February 13 to face indictment for the government s two-year refusal to ask Swiss authorities to re-open graft cases against President Asif Ali Zardari.

 

Earlier, Chaudhry Aitzaz requested the court to give him time from 10 to 15 days to submit his reply.

Nine-member bench of the Supreme Court led by Chief Justice Iftikhar Muhammad Chaudhry conducted hearing of the PM contempt of court case.

The counsel for the defense Barrister Aitzaz Ahsan said that he should be given 10 days to complete his procedure.

Aitzaz said that he could not explain the stance of the government within half an hour.

At this, the Chief Justice said that every judge wants peace and tranquility in the country.

 

Indian SC adjourns Kasabs death penalty appeal

India s Supreme Court adjourned an appeal hearing on Tuesday into the death sentence handed down to the lone surviving gunman from the 2008 Mumbai attacks.

 

Ajmal Kasab, one of 10 gunmen who laid siege to Mumbai in attacks which lasted nearly three days and killed 166 people, has appealed for his sentence to be overturned after he was convicted in May 2010.

 

He was found guilty of a series of crimes, including waging war against India, murder and terror acts.

 

The November 2008 attacks saw 10 heavily-armed Islamist gunmen storm targets including luxury hotels, a Jewish centre and a train station.

 

One of the two Supreme Court judges due to hear the appeal was unavailable on Tuesday, forcing the adjournment, officials said. No date was immediately set for the next hearing.

 

Kasab s court-appointed lawyer Raju Ramachandran told AFP that his job was “a call of duty”, but declined to talk further about the case.

 

India blames the Pakistan-based militant outfit for training, equipping and financing the attack.

 

Kasab s death sentence was confirmed by a state high court in Mumbai last year. If he loses his Supreme Court appeal, he will be able to appeal for clemency from the president.

 

Ujjwal Nikam, who prosecuted the case in Mumbai on behalf of the Maharashtra state, is seeking to push through the death sentence.

 

“This is the rarest of rare cases,” Nikam told AFP. “He should not be entitled to any mercy.”

 

At the trial, the prosecution produced fingerprint, DNA, eyewitness and television evidence showing him opening fire and throwing grenades at Mumbai s main railway station in the bloodiest episode of the attacks.

 

Kasab, who is in jail in Mumbai, initially pleaded not guilty but later made a confession. He then reverted back to his initial denial and said he was framed by the police.

 

Pakistan has indicted seven alleged perpetrators over the attacks but they have not been brought to trial, triggering Indian accusations that the process is a sham.

 

Pakistani investigators and lawyers will visit India next month to gather more evidence ahead of any trial in Islamabad.

 

Most death sentences in India are commuted to life imprisonment, and convicts can sit on death row for years awaiting a final decision.

Apple, Google poaching case will go forward

Google, Apple and five other technology companies must face a lawsuit claiming they violated antitrust laws by entering into agreements not to recruit each other s employees, a federal judge said.

 

US District Judge Lucy H. Koh in San Jose, California, Thursday said that even if she dismisses some claims, she will give the plaintiffs a chance to amend their complaint and re-file it.

 

Intel, Adobe Systems, Walt Disney s Pixar animation unit, Intuit and Lucasfilm are also named as defendants.

 

“They still have an antitrust claim that s going forward so I don t want to see any obstruction on discovery,” she told lawyers during a hearing.

 

The case is a private lawsuit brought on behalf of employees that mirrors claims the companies settled with the US Justice Department in 2010 following a probe. The companies agreed to refrain from placing “cold calls” to lure workers from competitors, the government said at the time.

 

Koh didn t take issue with the allegations about the agreements between individual companies, Joseph Saveri, a lawyer for the plaintiffs, said in an interview after the hearing. Instead, Koh has questions about “how it ties together,” or claims of an over-arching conspiracy between all the companies, he said.

 

Possible damages

 

The ruling requires the defendants to produce documents describing the agreements and permits lawyers to take depositions, Saveri said.

 

“We get to see what really happened,” he said, adding that damages in the case could amount to hundreds of millions of dollars.

 

While the accord “may have exposed defendants  illegal antitrust violations and put an end to them,” the agreements “did not provide any compensation to the employees defendants harmed,” lawyers for the plaintiffs said in a court filing.

 

Google said in a statement that is has “always actively and aggressively recruited top talent,” declining to comment further.
George Riley, a lawyer for Apple, and Robert Mittelstaedt, an attorney for Adobe, declined to comment immediately after the hearing. Zenia Mucha, a Disney spokeswoman, wasn t immediately available for comment after regular business hours.

 

Intel spokeswoman Laura Anderson, Intuit spokeswoman Sandra Corradetti, and a representative at Lucasfilm didn t immediately return calls seeking comment on Koh s ruling after regular business hours.

“It works well for us,” added Kenly, referring to their communal living arrangement. “It’s unconventional and it seems crazy to everybody else, but for us it works well, and we all love and respect each other and respect each other’s boundaries.”

Zulqarnain is still waiting for Political Asylum in England

He also phoned his brother and a media journalist, alleging he received a threat after close-fought match against the South African side.

After coming in London he talked to a private Pakistani electronic media channel and announced the decision of his retirement from international cricket. He said that

“I have decided it is best for me to retire from international cricket since my family and I are constantly getting threats, it is best for me to step down because I can’t play in these circumstances. But I would like to continue to play domestic cricket”.

An official of Pakistan Cricket Board told that Zulqarnain retrieved his passport from team management, saying he needed it to buy a mobile phone SIM card. The PCB announced an immediate inquiry and a fact finding committee to follow Zulqarnain’s case. The information shared with the PCB fact finding committee by the local authorities indicates that Zulqarnain has left the UAE for England, the PCB said in a statement. “The PCB continues to monitor all of this situation and is in contact with concerned authorities in this regard.”

Zulqarnain’s coming to London and leaving the team in such mysterious way was on the heels of September’s corruption scandal when three Pakistani players became embroiled in match-fixing allegations. Mohammed Asif, Mohammed Amir and the captain Sulman Butt are under suspension after being accused of accepting money via a middleman “Mazhar Majeed” to bowl no-balls at specific points and after specific known intervals in the fourth test match between Pakistan and England which was played in September.The wicketkeeper was questioned by officers of Scotland Yard and ICC Anti-Corruption unit in London.

On 4th of December former cricketer posted another message on Facebook that he would disclose all the secrets pertaining to spot-fixing within two days. In this message he again told about the threat calls and letters he and his family is receiving. But still nothing is disclosed by him. He has changed his lawyer and said that he did not want to talk about cricket matters until his Political Asylum application decision did not came.

The founder of WikiLeaks has warned that his supporters are primed to publish a ‘deluge’ of leaked government documents should his activities be curtailed by any country; where as his lawyer Mark Stephens says that the organisation held further secret material which it regarded as a thermo-nuclear device to be released if it needs to protect itself.

Julian Assange has distributed to fellow hackers an encrypted ‘poison pill’ of damaging secrets, thought to include details on BP and Guantanamo Bay. He believes the file is his ‘insurance’ in case he is killed, arrested or the whistleblowing website is removed permanently from the internet. Mark Stephens said Mr Assange would certainly fight deportation to Sweden on the grounds that it could lead to him being handed over to the US, where senior politicians have called for him to be executed. He said that the WikiLeaks site which was last week forced to move to a Swiss host after being dumped by US internet companies had come under siege from a huge number of cyber-attacks. WikiLeaks has been in the eye of a media and diplomatic storm since it started leaking US diplomatic cables from a collection of some 250,000 it had obtained, embarrassing and infuriating Washington. Assange, a 39-year-old Australian, who is believed to be in Britain, broke cover on Friday to say in an online chat that he had boosted security after receiving death threats. WikiLeaks says 831 cables have been posted to its site so far. His lawyer Mark Stephens also warned that WikiLeaks had secret material in reserve, which he likened to a thermo-nuclear device, to be released if it needed to protect itself.
