fe8feba56bn Plea.jpg SHC Dismisses Pervez Musharraf Treason PleaKARACHI, News Trends: Sindh High Court (SHC) discharged a petition regarding high treason charges against former President Gen (rtd) Pervez Musharraf and his associates.

The petitioner has been directed to go to Supreme Court (SC).

Petitioner Maulvi Iqbal Hyder filed the plea, which said Pervez Musharraf, resorting to extra-constitutional measure, imposed emergency on November 3, 2007 and put over 60 judges of higher judiciary under house arrest with all rampant willful decisions.

The Attorney General of the time Malik Qayyum and Sharifud Din Pirzada assisted him; thus, all the three committed high treason.

As no later assemblies gave constitutional protection to these measures; accordingly, the court was pleaded to take action against all these defendants under Article-6 of the Constitution.

The court, dismissing the plea, said the matter has come under hearing before the apex court; hence, any high court ruling in this regard is uncalled for.

Sindh High Court has disposed off a petition seeking filing of a treason case against former president General (r) Pervez Musharraf, Sharifuddin Pirzada and Malik Qayyum, Dunya News reported on Thursday.
A division bench comprising Chief Justice Sindh High Court Sarmad Jalal Usmani and Justice Abdul Hadi Khoso advised petitioner Maulvi Iqbal Haider to approach the Supreme Court in this respect.
The petitioner Maulvi Haider Iqbal contended that General Musharraf violated the Constitution by imposing emergency on October 3, 2007, which is tantamount to committing treason. The petition added that Musharraf amended the Constitution after his volitions thereby distorting the countrys most respected document. Maulvi Iqbal stated that Sahrifuddin Pirzada and Malik Qayyum incited Musharraf to contravene the Constitution and hence a case should be filed against the under Article 6 of the Constitution.

Sindh High Court on Tuesday deferred its ruling on a constitutional plea seeking filing of treason case against former president Gen (r) Pervez Musharraf, Sharifuddin Pirzada and Malik Qayyum till October 14.

Federal cabinet meets for steps on power crisis

ISLAMABAD: Prime Minister Syed Yusuf Raza Gilani is presiding over a session of the federal cabinet held to mull over the steps for the resolution of the energy crisis facing the country, Geo News reported Wednesday.

The session held at the PM Secretariat also endorsed the import of wheat and decisions taken by Economic Coordination Committee of the Cabinet (ECC) on March 30.

The Cabinet session is also mulling over the law and order situation and new wave of terrorism in the country.

The session will also give thought to the political scenario and the implementation of 18th Amendment after its passage.

The cabinet would be apprised of the economic situation of the country and negotiations with the International Monetary Fund (IMF).

Meantime, the meetings of four sub-committees constituted to implement the recommendations of Energy Conference are in progress in the federal capital.

The Cabinet approved the amendment in the draft intellectual Property Rights Organization of Pakistan Bill 2010.

The draft bill is already being discussed in the National Assembly Standing Committee. The Cabinet approved the amendment in the Islamabad Capital Territory (ICT) Zoning Regulations for ZONE-4 while the amendment for ZONE-2 was approved in principle but the Cabinet Committee would further deliberate on it for improvement.

The Cabinet Committee consists of Ministers for Law and Justice, Interior and Housing and Works.

SHC dismisses plea against Zardari’s eligibility

KARACHI: Sindh High Court (SHC) dismissed a constitutional petition regarding the eligibility of President Asif Ali Zardari on the plea that he wields immunity constitutionally, Geo News reported Wednesday.

A two-member SHC bench including Chief Justice Sarman Jalal Usmani and Justice Zahid heard the petition filed by Maulvi Iqbal Hyder.

The SHC said nobody can be declared as ineligible on the basis of pending cases and that the presidential election cannot be challenged in any court.

The petition pleaded the court to declare President Zardari as ineligible as the National Reconciliation Ordinance (NRO) has lapsed leading Zardari’s election to go null and void.

Maulvi Iqbal said in his petition that the NRO was in effect when the nomination papers were filed; accordingly, the approval or rejection of the papers was not challenged; but, now the court has restored all the cases to October 5 position.

Therefore, all the nomination papers should be re-scrutinized in this perspective that no NRO exists today.

However, the court clarified to the petitioner the presidential election cannot be challenged in any court under Article-41(6) of the Constitution.

But, the petitioner responded that the Article is applicable on the post-election situation and he has raised the point of Zardari’s eligibility in pre-election position.

The court turned down his viewpoint and dismissed his petition.

Talking to media later on, Maulvi Iqbal Hyder said he would challenge this order in the apex court.

PM was addressing the media from Federal Board of Revenue (FBR) office, he said “we would end sectarian violence.” He added “there is no second opinion to remove corruption from the society and from within the organizations,” the Prime Minister told. Gilani said he was at the FBR to ensure that the continuity of policies initiated by the outgoing Finance Minister Shaukat Tarin remain in place.
PM also hinted that the Advisor on Economic Affairs would be appointed soon, in consultation with former Finance Minister Shaukat Tarin.

The Election Commission of Pakistan (ECP) dismissed a petition challenging the electoral eligibility of President Asif Ali Zardari.
Maulvi Iqbal Haider had filed an application before the Election Commission against the electoral eligibility of President Asif Ali Zardari. ECP demanded for more evidences, and after reviewing the evidences ECP dismissed the application.
The ECP in its seven-page ruling termed the petition ineffective.

Chief Election Commissioner said that he would review whether the petition was worth hearing. In the application, the petitioner argued that NRO was intact during the 2008 presidential polls ,adding that now President’s eligibility could be challenged as NRO has been revoked. The CEC said that he would issue notices to concerned people only after figuring out whether the case is worth hearing or not. Petitioner Maulvi Iqbal Haider said that Article 248 was not imposed on Zardari when he contested the polls.

918932d19150x150 Musharraf treason case: SHC directs publishing call notice in papersKarachi, Pakistan:- The Sindh High Court (SHC) on Friday directed to publish a notice in newspapers to summon former president Pervez Musharraf for hearing of a petition filed to register treason case against him.

The petitioner Maulvi Iqbal Haider told the court that notices were not being received at former president’s residence in Chak Shahzad and report of disobedience had also come. The high court directed the petitioner to get permission and issue notices in newspapers.

Maulvi Iqbal Haider took position in constitutional petition being heard since March 28 that Pervez Musharraf violated his oath of office and overthrew the elected government. He suspended the constitution twice and made amendments according to his own will therefore treason case should be filed against him, the petition stated.
